Labona s.r.o., Company ID 03898881, processes your personal data in order to send you commercial communications (marketing offers) on the basis of its legitimate interests. You can object to this personal data processing at any time, from which point you will no longer be sent any commercial communications. THE CONTROLLER’S IDENTITY AND CONTACT DETAILS

1.1. 1.3. The Controller has appointed a data protection officer: Jana Löffelmann.

1.4. With respect to the personal data processed by the Controller, the obligation to inform is fulfilled herein solely for the purpose of sending commercial communications based on the Controller’s legitimate interests. It does not apply to processing of personal data by the Controller for other purposes or on other legal bases. In such cases, the Controller shall fulfil its obligation to inform separately.

THE LEGAL BASIS FOR THE PERSONAL DATA PROCESSING

2.1. The legal basis for your personal data processing is the fact that this processing is necessary for the legitimate interests pursued by the Controller or a third party as defined in point (f) of Article 6(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation; hereinafter referred to as the “Regulation”).

THE PURPOSE OF THE PERSONAL DATA PROCESSING

3.1. The purpose of processing your personal data is for the Controller to send you commercial communications as defined in Act No. 480/2004 Coll., on certain information society services and on amendments to some acts (Act on Certain Information Society Services), as amended (hereinafter referred to as the “Act on Certain Information Society Services”) when you as a customer of the Labona e-shop provide consent upon submitting an order.

3.2. The Controller does not conduct any automated individual decision-making as defined in Article 22 of the Regulation.

THE LEGITIMATE INTERESTS OF THE CONTROLLER

4.1. You have given the Controller your consent to the Controller sending you commercial communications pursuant to Article 7(2) of the Act on Certain Information Society Services or you have been the Controller’s customer within the meaning of Article 7(3) of the Act on Certain Information Society Services and at the same time, when collecting your personal data, the Controller gave you the option to express, in a clear, distinct, free, and simple manner, your disagreement with your electronic contact details being used for commercial communications.

4.2. When sending commercial communications, the Controller shall comply with the applicable laws and regulations, in particular the provisions of Article 7 of the Act on Certain Information Society Services.

4.3. Recital 47 of the Regulation states, among other things, that the “processing of personal data for direct marketing purposes may be regarded as carried out for a legitimate interest”.

4.4. The Controller has evaluated whether it is possible to process your personal data for the purpose of sending commercial communications and has conducted the required proportionality test, comparing the interests in your protection against the Controller’s interests. The Controller has reached the conclusion that with respect to your previous consent to receive commercial communications or with respect to the previous satisfaction of the requirements stipulated in the provisions of Article 7(3) of the Act on Certain Information Society Services and also with respect to the fact that you can at any time reject further sending of commercial communications, it does not seem that your interests or the basic rights and freedoms requiring the protection of your freely provided personal data take precedence over the Controller’s legitimate interests in sending commercial communications.

4.5. Taking into account what was mentioned herein above and taking into account the fact that you could reasonably expect your personal data to be processed for the purpose of sending commercial communications, the Controller presumes that the legal basis for the processing of your personal data for the purpose of sending you commercial communications is a legitimate interest for the Controller (Clause 1 hereof).

5.
PERSONAL DATA STORAGE PERIOD

5.1. The Controller will process your personal data for four (4) years following the date when the personal data were sent on the basis of a confirmed order or inquiry, but no later than until the time when you object, or make any other similar request, to the processing of your personal data for the purpose of sending commercial communications, including the exercise of your right to erasure of your personal data.

OTHER RECIPIENTS OF YOUR PERSONAL DATA

6.1. The other entities that will receive your personal data are those that provide marketing services for the Controller and the companies in the list of partners.

6.2. The Controller has no intention to pass your personal data to any third countries (any country outside the EU) or international organisations.

7.
THE RIGHTS OF THE DATA SUBJECT

7.1. Under the conditions set in the Regulation, you have the right to request access from the Controller to your personal data, the right to have your personal data corrected or erased, and the right to restrict the data processing.

7.2. Should you consider the Regulation to have been violated or to be violated by your personal data processing, you have the right, among other things, to lodge a complaint with a supervisory authority.

 

You always have the right to object to the processing of your personal data for the purposes of direct marketing, including profiling when the profiling concerns this direct marketing. If you object to your personal data being processed for the purposes of direct marketing, your personal data will no longer be processed for these purposes. This shall not affect the processing of your personal data on another legal basis or for another purpose.
